In accordance with section 37A of the Legal Practitioners Ordinance (Chapter 159), I hereby give notice that on 15 April 2008 a Barristers Disciplinary Tribunal found FONG E-fong, Candy (‘the Barrister’) guilty of 3 complaints of misconduct, namely:—
(i) engaging in conduct which brought the profession of barristers into disrepute contrary to paragraph 6(b) of the Bar Code;
(ii) engaging in conduct prejudicial to the proper administration of justice contrary to paragraph 6(b) of the Bar Code;
(iii) acting without due courtesy to the Court.
The Tribunal ordered, amongst others, that the Barrister be suspended from practising as a barrister for 9 months, 6 months and 3 months for the respective complaints, to run concurrently. The Tribunal also ordered that such period of suspension should commence after the appeal period, which appeal period was to run from 29 April 2008. Pursuant to section 37( f ) of the Legal Practitioners Ordinance, the Barrister was also ordered to pay the costs of, and incidental to, the proceedings of the Tribunal on a full indemnity basis.
The Order of the Barristers Disciplinary Tribunal was filed with me on 21 May 2008.

命令暫時吊銷大律師執業資格
方也方女士
本人現按照《法律執業者條例》(第 159 章) 第 37A 條的規定公布，大律師紀律審裁組於 2008 年 4 月 15 日裁定方也方女士 (‘該大律師’) 犯了三項行為失當的申訴事項，即:
(i) 作出導致大律師界聲譽受損的行為，違反了《大律師專業守則》第 6(b) 段; (ii) 作出不利司法工作妥善執行的行為，違反了《大律師專業守則》第 6(b) 段; (iii) 對法庭作出無禮的行為。
審裁組命令:就各項申訴分別暫時吊銷該大律師的大律師執業資格九個月、六個月及三個 月，同期執行。審裁組亦命令，暫時吊銷執業資格的期間應在上訴期間之後起計，上訴期間由 2008 年 4 月 29 日開始。同時，亦根據《法律執業者條例》第 37( f ) 條命令該大律師支付審裁組 的法律程序的事務費及附帶事務費，按完全彌償基準計算。
大律師紀律審裁組的命令於 2008 年 5 月 21 日送交本人存檔。
